Is PAT Testing a Legal Requirement in the UK?
One of the most common questions we get asked at Glow Compliance is whether PAT testing is actually a legal requirement. The short answer is — not directly. But the longer answer is far more important for your business.
What the Law Actually Says
There is no specific law in the UK that explicitly states “you must carry out PAT testing.” However, several pieces of legislation place a legal duty on employers, landlords, and business owners to ensure electrical equipment is safe:
- The Health and Safety at Work Act 1974 — requires employers to ensure the safety of employees and visitors
- The Electricity at Work Regulations 1989 — requires all electrical systems and equipment to be maintained in a safe condition
- The Management of Health and Safety at Work Regulations 1999 — requires employers to assess and manage risks in the workplace
- The Landlord and Tenant Act 1985 — requires landlords to ensure electrical installations and equipment are safe
PAT testing is the most widely recognised and accepted method of demonstrating compliance with these regulations. In the event of an accident, injury, or insurance claim, being able to produce a valid PAT test certificate could be the difference between being compliant and facing prosecution.
What Happens if You Don’t?
Without documented evidence of regular electrical safety testing, you could face:
- Invalidated insurance policies
- Prosecution under Health and Safety legislation
- Personal liability in the event of injury or fire
- Failure of a licensing inspection for HMOs, holiday lets, or hospitality venues
The Bottom Line
While PAT testing isn’t written into law by name, your legal duty to maintain safe electrical equipment effectively makes it a necessity. It is the industry standard method of proving your equipment is safe — and without it, you leave yourself legally and financially exposed.
At Glow Compliance, we provide fully certified PAT and EET testing across Plymouth, Devon, and Cornwall, giving you the documentation you need to stay protected.
